Welcome to Chapterwing. These Terms of Use ("Terms") govern your access to and use of the Chapterwing website at chapterwing.com and any related services we operate (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Chapterwing

Chapterwing ("Chapterwing," "we," "us," or "our") is an independently operated service based in Texas, United States. We produce and publish audiobook adaptations of literary works for educational and entertainment purposes, made available to listeners free of charge. The Service does not currently offer paid subscriptions, in-app purchases, or user accounts.

2. Eligibility

The Service is intended for users who are at least 13 years of age. If you are between 13 and 18, you represent that you have permission from a parent or legal guardian to use the Service. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. We may restrict or terminate access for any user who does not meet these requirements.

3. Description of the Service

Chapterwing provides streaming access to audio adaptations of literary works, including web novels, light novels, and other fiction. The audio is produced using text-to-speech and audio processing technologies, not human narrators, and may include synthetic voices, computer-generated effects, and automated post-processing. We make these adaptations available for personal, non-commercial listening through our website. See the disclosure section below for details on how the audio is produced.

The Service is provided free of charge. We may add, change, suspend, or discontinue features, content, or the Service as a whole at any time without notice or liability.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and stream content on the Service for your personal, non-commercial use. 7. AI-Generated Content Disclosure

The audio content on Chapterwing is generated by artificial intelligence text-to-speech and audio processing systems. AI narration may contain pronunciation errors, mispronounced names, awkward intonation, audio artifacts, or other quality issues that differ from professionally produced human-narrated audiobooks. We work to improve quality over time but do not guarantee that audio will match any particular standard or that errors will be corrected within any specific timeframe. By using the Service, you acknowledge and accept that the audio is AI-generated.

8. Copyright and DMCA

Chapterwing respects intellectual property rights and responds to valid takedown notices in accordance with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, please review and follow the procedures set out in our DMCA Policy.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information about you. By using the Service, you agree to the practices described in the Privacy Policy.

We do not warrant that the Service will be available at any particular time, that errors will be corrected, that the Service or its servers are free of viruses or harmful components, or that any content is accurate, complete, or reliable. Audio quality, content availability, and service features may change without notice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHAPTERWING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN WHICH CASE THESE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless Chapterwing and its operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Federal copyright law and the Digital Millennium Copyright Act apply to intellectual property matters as relevant.

Any dispute arising out of or related to these Terms or the Service that is not resolved informally must be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts. You and Chapterwing waive any objection based on inconvenient forum.

You and Chapterwing each agree that any dispute will be resolved on an individual basis, and you waive any right to bring or participate in a class action, collective action, or representative proceeding.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, with or without notice. You may stop using the Service at any time. Upon termination, sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes may be announced through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.

16. Miscellaneous

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Chapterwing regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations at any time without notice.
